<p>I have just read <name type="person">Dr. Pike</name>'s letter of <date value="1956-05-04">May 4, 1956</date>, which was <lb/>
written to the Chancellor. I would appreciate your giving me <lb/>
a report in the very near future of all the <hi rend="underline">special nuclear <lb/>
material</hi> on this Campus for which you, as acting director of <lb/>
the nuclear reactor, must account for. I would also like to <lb/>
have a statement from you which would cover all the uranium <lb/>
fuels that have come to <name type="place">North Carolina State College</name> to be <lb/>
used in the reactor. </p>

<p>I would appreciate very much your doing this so that my detailed <lb/>
knowledge of this situation will be accurate. I am sure the <lb/>
Chancellor would also like to have this information. <name type="place">Dr. Pike</name>' s <lb/>
letter contains some comments and suggestions which I think you <lb/>
should reply to and work out procedures regarding the fuels so <lb/>
that we can be assured that all necessary regulations, licenses, <lb/>
etc., are in our hands and we are in the boundaries of regula- <lb/>
tons. I will indeed appreciate your help in this matter.</p>

<p>This is in response to your transmittal to the Committee of a <lb/>
copy of your letter of April 24 to <name type="person">Mr. H. L. Price</name>, which per- <lb/>
tained to the reporting on <hi rend="underline">special nuclear material</hi>.</p>

<p>Unfortunately, the Committee has none of the information <lb/>
necessary for reporting on <hi rend="underline">special nuclear material</hi>. Especially <lb/>
it does not have the information, and has not been able to obtain <lb/>
it, concerning the loss of enriched uranium consequent to the <lb/>
various Reactor leaks. You are referred to past correspondence <lb/>
from the Committee in this regard.</p>

<p>It appears certain that some enriched uranium (<hi rend="underline">special nuclear <lb/>
material</hi>) has been lost on this campus, with most of it going <lb/>
down the <name type="place">Raleigh</name> sewer system. Estimates that I have heard <lb/>
range from 10 milligrams to 50 grams. The recent NCSC-132 re- <lb/>
port of <name type="person">Dr. C. K. Beck</name>, on page 27, shows 8 grams - (U-235) un- <lb/>
accounted for by an estimated material balance. However, I <lb/>
emphasize that the basis for the 8 gram estimate has never been <lb/>
revealed and is questionable. Further, the way events have <lb/>
occurred, it is no longer practical and perhaps not possible to <lb/>
find out how much was lost, mainly because an indeterminate amount <lb/>
has been buried in <name type="place">Oak Ridge</name>.</p>

<p>The <name type="corporate"><abbr expan="Atomic Energy Commission">AEC</abbr></name> regulations clearly state that <hi rend="underline">any</hi> loss must be reported. <lb/>
Accordingly, <name type="person">Dr. Beck</name> should have reported, or should report, <lb/>
this loss. The Committee has no information on what has been <lb/>
reported to the <name type="corporate"><abbr expan="Atomic Energy Commission">AEC</abbr></name>. </p>

<p>I feel that neither the Committee, nor anyone else, will want <lb/>
to assume the responsibility for an indeterminate amount of en- <lb/>
riched uranium with such a clouded history.</p>

<p>Under the circumstances, I suggest that the most appropriate <lb/>
actions are as follows:</p>
<list>
<item><p>1. That the Chancellor have Dr. C. K. Beck complete the reports <lb/>
to the AEC for the period of time up to the formal transfer of <lb/>
responsibility on the AEC records. These reports should be <lb/>
transmitted by the Chancellor in the near future.</p>

<p>Incidentally, there are several categories of <hi rend="underline">special <lb/>
nuclear material</hi> on this campus , <sic>altho</sic> the fuel uranium is easily the <lb/>
most important. For instance, there is an 80 gm enriched <lb/>
uranium foil used for neutron experiments and some enriched <lb/>
uranium in fission counters.</p></item>

<item><p>2. That the Chancellor obtain from Dr. C. K. Beck the past re- <lb/>
cords, including reports to the AEC, on <hi rend="underline">special nuclear material</hi>, <lb/>
and the <hi rend="underline">license</hi> to possess a utilization facility (nuclear reactor). <lb/>
The license can and quite possibly does, contain special AEC re- <lb/>
quirements on the reporting, handling and transfer of the <hi rend="underline">special <lb/>
nuclear material</hi> used for fuel, beyond or in substitution for the <lb/>
normal regulations spelled out in the Code of Federal Regulations.</p></item>

<item><p>3. That the total amount of unaccaounted-for uranium be determined <lb/>
by the AEC, before formal transfer of responsibility is made on <lb/>
this campus. The problem of the unaccounted-for uranium will have <lb/>
to be faced sometime, and it is far better that it be done now.</p>

<p>Recall that the unaccounted-for uranium consists of either uranium <lb/>
lost on this Campus or uranium that was buried (or lost) in Oak <lb/>
Ridge. Quite possibly this distribution will never be determined.</p>

<p>The <hi rend="underline">total</hi> amount of unaccounted-for fuel uranium can be determined <lb/>
rather readily by shipping back to Oak Ridge for measurement all <lb/>
(or part) of the various waste amounts here. Presumably the <lb/>
amount already shipped to Oak Ridge has been measured or could <lb/>
readily be measured.</p>

<p>We do have two sealed and unopened bottles of uranium fuel solution <lb/>
which are reported to contain 150.47 grams U-235. Instead of <lb/>
shipping the sealed batches back for verification, we might well <lb/>
accept their stated compositions. In that case, the amount to <lb/>
be shipped is quite small. The original total amount (999 grams) <lb/>
minus the amount already in Oak Ridge that can be accounted for <lb/>
(not buried), minus the amount in our wastes to be shipped, minus <lb/>
the 150.47 grams in sealed containers will accurately define the <lb/>
total amount unaccounted-for. </p>

<list><item><p>4. That the formal transfer on the AEC records of responsibility <lb/>
on this campus for <hi rend="underline">special nuclear material</hi> (or at least, for the <lb/>
fuel uranium) await the clarification of the total amount involved.</p>
</item>
<item><p>5. That the Acting Director of the Reactor apply to the Coramittee <lb/>
on Safety and Health for permission to acquire and use <hi rend="underline">special <lb/>
nuclear material</hi>, one application for each distinct lot.  This <lb/>
would treat <hi rend="underline">special nuclear material</hi> as any other radioisotope <lb/>
from a Safety and Health point of view, as required by our Campus <lb/>
Regulations, and as it should be.</p>

<p>The Committee could then grant permission, with the specifications <lb/>
that it be kept properly informed. What this means could be agreed <lb/>
upon by conference with the Chancellor.</p></item>
