Performances & Displays

If the performance or display is to be transmitted, section 110(2) of the Copyright Act may apply, although none of these sections precludes fair use. This section was recently updated through passage of the Technology, Education, and Copyright Harmonization Act (TEACH).The TEACH revisions to the copyright act authorize the tranmission, performance, and display of certain kinds and amounts of works under specified conditions and restrictions.

TEACH allows:

Who: Nonprofit educational institutions or governmental bodies to
What: Perform: -- nondramatic literary works
-- nondramatic musical works
OR
  Display: works in an amount comparable to that displayed in a live classroom setting
But Not:

Works produced or marketed primarily for performance/display as part of mediated instructional activities transmitted via digital networks, i.e., digital works produced for the educational market

OR

  Copies that were not lawfully made
When:

Transmission must be under the direction or supervision of the instructor
as an integral part of class session and
as part of systematic mediated instructional activities
if directly related and of material assistance to the teaching content

How: Transmission must be solely for reception limited to students enrolled in the course
There must be technological measures that reasonably prevent retention and unauthorized further dissemination.
